Biography

Ilya Shapiro is a member of our Issues and Appeals law practice. He regularly practices in the United States Supreme Court and appellate courts across the country. He also works with trial teams to develop legal strategy, lead motions practice, and ensure a clean record for appeal. He help clients solve difficult legal problems outside the courtroom and help them anticipate and mitigate legal risk.

Ilya has filed over 500 amicus briefs in the United States Supreme Court alone. He is a senior fellow and director of constitutional studies at the Manhattan Institute. Previously he was executive director and senior lecturer at the Georgetown Center for the Constitution, and before that a vice president of the Cato Institute and director of Cato’s Robert A. Levy Center for Constitutional Studies.

Earlier in his career, Shapiro was a special assistant/adviser to the Multi-National Force in Iraq on rule-of-law issues and practiced at Patton Boggs and Cleary Gottlieb. Before entering private practice, he clerked for Judge E. Grady Jolly of the U.S. Court of Appeals for the Fifth Circuit. He holds an AB from Princeton University, an MSc from the London School of Economics, and a JD from the University of Chicago Law School.

Representative matters:

  • Coordinated amicus briefs in the constitutional challenges to Obamacare 2010-12
  • Represented challengers to Puerto Rico’s Covid rules (most restrictive of any U.S. jurisdiction), including appearing in federal court to cross-examine experts
  • Presented oral argument as amicus in Sixth Circuit property-rights case, securing affirmance of district court ruling
  • Manages one of the top amicus programs in the country, with his move from Cato to MI, and the resulting shift in power dynamics, having been dubbed the “Ilya Shapiro effect” by the leading expert on Supreme Court analytics
